The arbitrator shall have no authority to conduct a class arbitration proceeding. If this waiver is found to be unenforceable for any reason, the arbitration provision in its entirety shall be null and void.

11.4 Exceptions

Notwithstanding the foregoing, either party may seek emergency injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm pending resolution of a dispute. Additionally, claims arising under intellectual property rights, as described in Section 6, may be brought in court rather than arbitration.

11.5 Time Limitation on Claims
